Fox News is reporting that a Needville, TX high school student is facing in-school suspension after he refused to stand for the Pledge of Allegiance.  Mason Michalec, a sophomore at Needville High School, told KHOU.com that he refused to stand for the Pledge because of his opposition to government spying via the NSA.

The 15-year-old has been staging a silent protest for most of the school year, but ran into fresh trouble when a different teacher noticed him not rising for the Pledge.  Michalec tells KHOU-TV:

“She told me, 'This is my classroom. This is the principal’s request. You’re going to stand...and I still didn’t stand and she said she was going to write me up."

Michalec said that following the two day in-school suspension the principal warned him that he would ‘face more suspensions if his protests continued’.  Michalec feels that his First Amendment right has been violated by the school.

Tell us what YOU think about this situation.  Is Michalec being unpatriotic or exercising his First Amendment right?
